Privacy Policy

This Privacy Policy and Notice at Collection (“the Policy”) explains how TTX Company and its operating groups, subsidiaries and affiliates (collectively “the Company,” “us,” “we,” or “our”) collects, uses, retains, discloses, and otherwise processes personal information about individuals or households who engage in in-person or online interactions with us, including via our website at ttx.com (“the Website”). It also describes your choices and rights with respect to your personal information. If you do not agree with this Privacy Policy, you should not use our Website.

Certain terms used in this Policy have the meanings given to them in the California Consumer Privacy Act of 2018, as amended (“CCPA”).   1. Personal Information We Collect

Depending on your interactions with us, we may not have collected each of these categories of personal information about you. However, we may collect (and may have collected during the 12-month period prior to the effective date of this Privacy Policy) the following categories of personal information about you:

  • Identifiers, such as your real name, alias, postal address, unique personal identifier (e.g., device identifier, unique pseudonym, or user alias/ID), online identifiers, IP addresses, email address, account name, and other similar identifiers.

  • Internet or other electronic network activity information, such as information about your device(s) when accessing our websites and your usage details of our websites, information you provide when filling in forms on our websites, or information you provide when requesting further information, products, or services from us.

  • Categories of personal information described in California Civil Code § 1798.80, such as name, signature, telephone number, financial information such as bank account number, credit card number or debit card number, or other financial information, passport number, state identification card number, and driver’s license number.

  • Professional and employment-related information, such as information relating to your position, (e.g., job title, job description, or department), employment status, employment history, business email address, or other information relating to your role at a company that is our Customer or Supplier.

  • Commercial Information, such as records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

  • Geolocation data, such as time and physical location related to use of an internet website, application, device, or physical access to an office location.

  • Sensory or surveillance information, such as video surveillance of our physical locations.

  • Inferences and profiles based on other personal information, such as information about your behavior, preferences, characteristics, psychological trends, or predispositions.

  • Other information you choose to provide.

We do not collect or process “sensitive personal information” (as defined under the CCPA) for the purpose of inferring characteristics about you.

  1. Sources of Personal Information

During the 12-month period prior to the effective date of this Privacy Policy, we may have collected or received personal information from the following sources:

  • Information You Actively Submit: You may provide information to us directly when you interact with us, such as if you send an email to our team, fill out a form on or otherwise send us information through our Website, or otherwise interact with us directly.

  • Information We Collect Automatically: We collect information using logging and analytics tools, cookies, pixel tags, and other similar technologies on our website.

  • Information Collected from Third-Party Sources: We may also receive the categories of personal information identified above from third party sources such as our service providers and business partners.

By providing us with personal information, you agree that you are authorized to provide us with such information. Where the information you are providing pertains to someone else, you acknowledge that you are required to inform them of the contents of this Privacy Policy.

  1. Use, Disclosure, and Other Processing of Personal Information

We may use, disclose, or otherwise process (and may have used, disclosed, or otherwise processed during the 12-month period prior to the effective date of this Privacy Policy) your personal information for the purposes of:

  • Providing our Website and supporting the features and contents available to you.

  • Personalizing your digital experience with us, including enhancing features and designing relevant alerts, products or services.

  • Providing you with information or services that you request from us, including providing customer service, processing payments or orders, and letting you access certain information that is specific to you.

  • Understanding how you and others use our Website and to determine what features and services may interest you or our other clients.

  • Operating and improving our organization and our services, including to enter into transactions with you or your organization, and manage our relationship with you or your organization, including orders and invoicing.

  • Communicating with you and others, including responding to requests and inquiries, providing support, promoting content, assisting with marketing, interacting over social media, and notifying you of changes to our Website.

  • Troubleshooting, de-bugging, and otherwise addressing issues that may arise with the functionality of the Website.

  • Helping to ensure security and integrity, to the extent the use of your personal information is reasonably necessary and proportionate for these purposes.

  • Protecting the legal rights, property, safety, and security of records or information, our clients and Website users, our organization and others, including detecting and preventing fraud, misuse of the Website, and other unauthorized activity.

  • Complying with industry standards, applicable law, judicial process, any properly authorized civil, criminal, or government or regulatory investigation or request, or any subpoena or summons issued by a competent authority.

  • Enforcing our policies, terms of use, or rights arising from contracts.

  • Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by TTX.

  • For other such purposes as you may authorize, or as is otherwise compatible with the above purposes or your reasonable expectations.

We may de-identify personal information by removing any details that identify you personally. If we do so, we will maintain and use the de-identified data without attempting to re-identify it. De-identified data will not be subject to this Policy and will be used to the extent permissible under applicable law.

  1. Retention of Personal Information

We retain personal information for as long as necessary to carry out the processing activities described in this Privacy Policy, including providing our Website and supporting its features and contents, providing you with customer service, answering your queries, compliance with applicable laws, regulations, rules, and requests of relevant law enforcement and/or other governmental agencies, and protecting our, our employees’, and our business partners’ and clients’ rights, property, or safety and the rights, property and safety of others. We may retain personal information for a longer period of time if a longer retention period is required or permitted by applicable law, as well as our records retention requirements and policies. For example, we may retain your personal information for longer periods of time, such as to carry out our operations, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, comply with applicable laws, or based upon other criteria, including, but not limited to, the sensitivity and volume of such data. In specific circumstances, we may also retain your personal information for longer periods of time so that we have an accurate record of your dealings with us in the event of any complaints or challenges.

  1. Disclosures of Personal Information for a Business Purpose

We generally disclose, and in the preceding 12 months we may have disclosed, the categories of personal information listed above to the following categories of entities for business or commercial purposes as described in this Policy:

  • To personnel at our subsidiaries and affiliates;

  • To our service providers, including our contractors and vendors who process personal information on our behalf and who support our continued provision of products, services, and the Website; and

  • To third parties such as regulatory authorities or other third parties in response to legal process or other legal reporting requirements; and to potential buyers (and their agents and advisors) in connection with any proposed merger, acquisition, or any form of sale or transfer of some or all of our stock or assets (including in the event of a reorganization, dissolution, or liquidation); trade union representatives (if applicable); and other similar third parties where disclosure is required for an ordinary business purpose in connection with our provision of services.

We do not currently:

  • Sell your personal information;

  • Share or disclose your personal information for cross-context behavioral advertising;

  • Use your sensitive personal information for purposes other than those allowed by the CCPA as set out in Cal. Code Regs. tit. 11 § 7027(m); or

  • Sell or share the personal information of individuals under 16 years of age as those terms are defined under the CCPA.

  1. Unsubscribing from Messages and Controlling Your Data

Where applicable, you may unsubscribe from our marketing communications by clicking on the “unsubscribe” link located at the bottom of our e-mails.

Your web browser may have a “Do Not Track” feature that is intended to automatically inform websites you visit not to track your online activities. Our Website may not respond to “Do Not Track” signals from your browser or to “universal opt-out mechanisms” because we do not engage in targeted or behavioral advertising on our Website. We may provide links to other third-party websites and services for your convenience. Those sites and services are not subject to this Policy. The operators of the linked websites and services may have posted their own privacy policies that you should review to learn more about their privacy practices.

  1. Confidentiality and Protection of Your Personal Information

We have implemented security measures designed to secure your personal information against accidental loss and unauthorized access, use, alteration, or disclosure. Nevertheless, although we endeavor to safeguard your personal information, no method of electronic transmission or storage can be guaranteed completely secure, and we cannot guarantee that your personal information will remain secure in all circumstances.

You also play a role in the security of your personal information. Accordingly, it is important for you to protect against unauthorized access to your account and device. If you have created an account with us, please safeguard and do not share your credentials.

  1. California Consumer Privacy Rights and Choices

The CCPA provides California residents with specific rights regarding their personal information. This section describes those rights and explains how California residents may exercise them.

  • Know and Access: You have the right to request, twice in a 12-month period, that we disclose the personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you.

  • Correction: You have the right to request that we correct the personal information we maintain about you, if that information is inaccurate.

  • Deletion: You have the right to request that we delete certain personal information we have collected about you, subject to certain exceptions.

  • Portability: You have the right of portability, or the right to have us transfer your personal information to other persons or entities upon your request.

  • Non-Discrimination: You have the right to not be discriminated against for exercising your privacy rights.

  • Rights related to Automated Decision making: The Company does not presently use automated decision making technologies (ADMTs), as defined by the CCPA and its regulations, with respect to consumers subject to this Policy.

How to Submit a Request

You can exercise your privacy rights by submitting a request to us at [email protected] or calling us at (312) 853-3223. The verifiable request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. The verifiable request must also describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Verifying Requests

To help protect your privacy and maintain security, we will take steps to verify your identity before granting access to your personal information or complying with your request. If you ask us to provide you with specific pieces of personal information, we may require you to sign a declaration under penalty of perjury that you are the individual whose personal information is the subject of the request and provide appropriate proof of identity. For requests to know or delete information about a child under the age of 13, we accept requests for information regarding minors under the age of 13 if we can determine that such requests were submitted by a parent or guardian.

Authorized agents may initiate a request on your behalf using the same methods described above. Authorized agents will be required to provide proof of their authorization, and we may also require that you directly verify your identity and the authority of the authorized agent. You may also provide us with a signed and dated power of attorney naming the authorized agent as your representative.

Responding to Requests

Within 10 days of receiving your request to delete, request, or to know, we will confirm receipt of the request and provide information about how we will process the request. Generally, we will respond to your request within 45 days. If we need more time to respond, we will provide you with notice and an explanation of the reason we need more time to respond.

We may deny your request if we cannot verify your identity or are legally permitted to deny the request, such as if doing so proves impossible or would involve disproportionate effort. If we deny your request, we will explain the basis for the denial, provide or delete any personal information that is not subject to the denial, and refrain from using the personal information retained for any purpose other than as permitted by the denial. We will maintain a record of your request and our response for 24 months. To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request if the request is manifestly unfounded, excessive, or repetitive.

  1. Children’s Privacy

Our website is not intended for or designed to attract children under the age of 18, and we will not knowingly solicit or collect personal information from children we actually know are under 18.

We may update this Notice to reflect the changes in our privacy practices at any time and without prior notice to you. When we do so, we will update the Effective Date above. We encourage you to periodically review this Notice for the latest information on our privacy practices.
